On January 1st, 2024, Florida passed a new law stating that drivers must move over for all disabled vehicles that display emergency flares and signage, hazard lights, or that have one or more persons visibly present when stopped.
The previous House Bill 425 required drivers to move over a lane for tow trucks, first responders, and other emergency vehicles. Now the “Move Over” law will include all disabled vehicles. Drivers will now have to move over a lane or slow down to 20 mph under the speed limit for any driver stranded on the side of the road with any emergency signal on.
According to AAA, an average of 350 people per year were killed while standing outside a disabled vehicle on the side of the road. Data shows that tow truck operators are more at risk since they’re killed at a rate of 43 deaths per 100,000 workers. In 2023, the Florida Highway Patrol revealed there were 176 crashes throughout the state caused by people not moving over. By enforcing this new law, Florida has made it safer for workers to do their jobs on the road.
Officials say violators may be cited with a noncriminal moving violation and a fine of $158 for not moving over.
